Statement on the charges against protesters of the Sunflower Movement in
Taiwan

On February 10th 2015, the Taiwanese government brought criminal charges
against 119 of its citizens, mostly students and young professionals, for
participating in or organizing peaceful demonstrations during the Sunflower
Movement of spring 2014.

Markus Löning, Vice-President of Liberal International and Chair of its
Human Rights Committee, has called for the charges to be dropped, asserting
that such actions are an affront to Taiwan’s democracy: “Governments must
protect their citizens’ right to protest peacefully under any circumstances.
Peaceful protest is a fundamental human right protected by the Universal
Declaration of Human Rights. The Taiwanese government is urged to drop all
criminal charges against these citizens for their participation in, and
organization of, a peaceful demonstration during the Sunflower Movement.

 “In contrast, there has been no independent or thorough investigation into
violence perpetrated by police officers against peaceful protestors. Police
officers were seen hitting the protesters with their shields and batons, yet
none of them have been identified or held responsible by the National Police
Agency.

“Taiwan has been a shining example of rule of law and democracy in Asia for
many years. This is why it is even more important that Taiwanese authorities
uphold their international commitments; drop charges against the students and
investigate the conduct of police officers. Young people fighting for their
country’s democracy should have the full backing of their government.

“Taiwan adopted the International Covenant on Civil and Political Rights in
2009, and a citizen’s right to assemble and demonstrate peacefully is one of
the seminal obligations included in the ICCPR. By the government’s own
admission, Taiwan’s Parade and Assembly Act violates the ICCPR and the crime
of “Obstructing Official Duties” is so vague and the standard so
subjective, that it should not be used as substitute for the Parade and
Assembly Act.

“I encourage the complete overhaul of the Parade and Assembly Act in order
to bring the laws in to adherence with international standards to protect
Taiwanese citizens’ fundamental social and political rights.”
